MINUTES

1.  6:30 p.m. Closed Session (Part or all of a meeting may be closed to the public under special conditions.  The Board may only consider matters covered in the agenda descriptions.)

A.    Conference with Legal Counsel--anticipated litigation pursuant to California Government Code Section 54954.5(c).  Significant exposure to litigation pursuant to subdivision (b) of Section 54956.9.  One potential case.

B.   Existing and/or Potential Litigation Pursuant to Government Code Section 54956.9 (a) and (b)-Conference with Legal Counsel:

1.    MPRPD and Friends of the Carmel River Trail vs. Carmel River Stables, LLC, Case No. S159319

2.  Report On Return From Closed Session  - President Ben Post announced that no reportable action was taken. 

3.  7:00 p.m. Regular Meeting/Roll Call – President Post called the meeting to order at 7:08 p.m.

PRESENT:  Directors Adamson; Dainton; Lagier Fellguth; Dalessio and Post

4.  Approval of Agenda Upon motion by Director Lagier, seconded by Director Dainton, the motion was unanimously approved.

5.  Public Comments – Paul Finnegan expressed his appreciation and support for the Let’s Go Outdoors programs and cited a couple of examples of the positive impact he believes they and the District are having on residents of the peninsula.

Nancy Larrew read a letter on behalf of Ms. Simone Sprague, expressing her and her daughter’s experiences and appreciation for the District’s summer camp programs.

6.    Presentations - Environmental Education Coordinator  Joseph Narvaez presented the Board with an overview of the Environmental Education and Community Outreach Division’s vision statement, 2008-09 accomplishments, and Spring 2009 Let’s Go Outdoors! (LGO) activities guide preview.

7.  Consent Items – After pulling items A and D for discussion, the remaining consent items were unanimously approved.

A.   Approval of April 6, 2009 Minutes

      - Director Dainton asked that the minutes be corrected to reflect that “President” Post was absent Vice President Adamson presided at the meeting; and that Director Dainton and GM Donofrio attended the Pacific Grove Chamber of Commerce “awards presentation luncheon”, not “meeting”.

B.   Approval of Summary of Payments

C.   Written Communications

D.   Approval of Resolution #2009-07, Resolution of Intention to Levy Assessments for the Fiscal Year 2009-2010, Preliminarily Approving the Engineer’s Report and Providing Notice of Hearing of the Monterey Peninsula Regional Park District’s Park, Open Space and Coastal Preservation District and Approval of Resolution #2009-08, Resolution Certifying Compliance with State Law with Respect to the Levying of General and Special Taxes, Assessments, and Property-Related Fees and Charges.

-       General Manager Joe Donofrio reported that there were several typographical errors in the Engineer’s Report and he advised the Board of the corrected pages.

E.   Approval of Request for Proposals for Preparation of FY 2008-09 Annual Financial Report (Agency Audit) 

F.    Approval of Contract with Byte Technology for Website Redesign Services

After discussion, the Board unanimously approved items A and D, pending the changes noted above.

8.  Directors Reports – Director Dainton, along with several staff members, attended the Fort Ord Dunes State Park opening.   She attended the Earth Day celebration at Locke-Paddon Community Park and led a LGO Tremendous Trees hike at Mill Creek Redwood Preserve. 

Director Lagier reported attending the Marina Garden Tour on May 3 and while there, spent time talking with Marina Mayor Bruce Delgado and a few planning commissioners.  She also recently hiked Garland Ranch Regional Park (GRRP).

 President Post attended the Monterey County Special Districts Association Meeting.  He recently learned that there might be federal funds available for mitigation projects, for which the District may apply.

9.  General Manager’s Report GM Donofrio attended the Special District Managers group meeting where Seaside and Monterey City Managers Ray Corpuz and Fred Meurer discussed how cities and special districts may work together in the future to reduce costs in providing services to the public.  He also reported attending the Fort Ord Dunes State Park opening.  Reminded all that the Cachagua Country Fair will be Saturday June 20, 11:00 a.m. to 9:00 p.m.  The Board/Manager retreat was discussed and tentatively scheduled for Saturday, July 11, from 10:00 a.m. to 2:00 p.m. at the GRRP museum.

Operations Manager Alan Miyamoto reported that the speed limit at GRRP going toward the museum will be lowered to 10 MPH because of increased traffic and safety concerns.  The equipment driven trail work at Palo Corona Regional Park is near completion, the remaining work will be done by hand.  He also invited Board members to contact him if they would like a tour to see the current progress.
